In February 2022 I suffered a broken ankle with ligament and nerve damage in a training accident at work. As the injury was caused by the instructor of the session, I pursued a claim against my employer and was represented by Roger Henderson from Rundlewalker Solicitors.

Upon approaching my employer’s legal department, we were met with a ‘stonewall’ denial of any liability on their behalf. There followed an 18-month dispute between my employer’s legal team and us whereby numerous issues were explored including detailed examination of training paperwork, risk assessments, standard operating procedures, and witness testimonies. During this time medical assessments were obtained.

After 18 months my employer softened their stance and approached us without prejudice to explore a settlement. Roger and I discussed this at length with Roger explaining the implications of settling at this stage against waiting longer for a greater appreciation of the potential recovery from the injury. I decided to wait and further medical and psychological assessments were received. After 2 years of negotiations and arguments with my employer’s legal team in July 2024 we received an agreeable settlement offer which was increased after further negotiations from Roger. This was a settlement my family and myself were over the moon with and the matter was closed.

Throughout the entire process Roger was knowledgeable, professional, and available. I would describe the denial from my employer as ‘ferociously absolute’ and Roger worked tirelessly to systematically deconstruct their arguments. I have no doubt this caused my employer to attempt to settle after 18 months. It was very tempting to settle at this point but Roger’s explanation and exploration of the pros and cons of settling without a full injury prognosis led to me making a fully informed decision to wait. I have no doubt this led to vastly increased settlement figure being achieved. The delayed settlement also involved further expense for Rundlewallker and my union around medical and psychological assessments which again, increased the settlement figure.

I would like to thank Roger and his team for achieving compensation for my family and myself. The injury and subsequent recovery were extremely stressful, lengthy and upsetting for all my family and the compensation has resulted in an extremely happy ending for us. I have no doubt that if it hadn’t been for Roger’s endeavour and fortitude, I would not have received any compensation, and his determination to achieve as much compensation as possible led to an increase on the original offer.
